Who Employs You, Who Controls the Site

Turnaround and maintenance work is largely contracted out. The plant owner controls the premises; your employer controls your crew; a third company may own the equipment involved.

Premises liability against the plant owner, negligence against another contractor, and a workers’ compensation or non-subscriber claim against your own employer can all exist in the same incident.

Which of those are available depends on the contracts and on who actually directed the work — not on who signs your cheque.

The plant owner, your employer and another contractor may each owe you something different.
